Probate is when someone with an official will dies and their estate is taken in by the court until certain requirements are met for it to be distributed to the heirs and beneficiaries. The Probate Procedure

A way to avoid probate all together is to instate your property within a revocable or irrevocable trust. If you take this route, then the court’s never get involved in the distribution of the grantor’s assets and estate but most likely be subject to estate taxes.
The entirety of testator’s estate may not enter probate as it may have been passed to another party contractually, depending on whether it is tied to an insurance policy stating that the recently deceased, a creditor, or retirement account is maintained as “payable on death,” or has a beneficiary addressed. The property, at times a bank/brokerage account, is held under contract as ‘jointly owned with right of survivorship.’
Upon death of the testator, a probate case is opened with the court and an executor is assigned. The executor, sometimes referred to as the personal representative, become sole owner of the decedent’s assets and estate. It is their responsibility to notify the courts of all the assets they have now gained ownership of. After, they must pay of any debts the grantor has accumulated in their lifetime and pay off estate taxes. In the end, the executor follows the wishes of the decedent and distributes the assets as stated in their will or if the there is no will, which means the decedent dies intestate, there are laws in which they must follow for distribution.
At any point during probate administration, any party involved can contest the process if they feel the validity of the will was compromised, feel as though the executor isn’t following the decedent’s wishes properly and question the identity of the beneficiaries/heirs. There are fiduciary duties that the personal representative must familiarize themselves with and follow accordingly. For instance, they must place money received through probate into an interest-bearing account and to treat all parties that are confirmed to receive a piece of the estate equally. If the personal representative does not follow these duties, then they’re eligible to be contested for removal and held accountable for any harm done to the estate by any parties involved in the probate administration.
